RESOLUTION NO. 2019-11-02 RESOLUTION REGARDING THE VACATION OF A STREET KNOWN AS OAK AVENUE

BY THE TOWN BOARD OF THE TOWN OF SCOTT:

WHEREAS, the Town of Scott has determined pursuant to Section 66.1003 Wis. Stats. that the public interest requires that a street known as Oak Avenue, Town of Scott, be abandoned, vacated and discontinued as a public street and the same is set forth and shown on the map attached hereto (Exhibit A) and incorporated by reference herein along with the legal description stated on Exhibit A for the proposed discontinued public street. 

NOW, THEREFORE, BE IT RESOLVED: That it is in the public interest that a street known as Oak Avenue be abandoned, vacated and discontinued by the Town of Scott as a public street and that a hearing was held on the abandonment, vacation and discontinuance of the same on the 4th day of April, 2019 at 4:00 p.m. at the Town Hall for the Town of Scott, 2621 Jody Drive, New Franken, Wisconsin.

BE IT FURTHER RESOLVED that a notice of such hearing was served on the owners of the frontage of the lots and lands abutting the public street sought to be abandoned, vacated and discontinued at least thirty (30) days before such hearing, and that notice of such hearing was published in the official newspaper of the Town of Scott once a week for two (2) successive weeks before the date of the hearing; and

BE IT FURTHER RESOLVED that the Town Attorney, upon adoption of this resolution, cause a Lis Pendens to be prepared and filed with the Register of Deeds, Brown County, Wisconsin, pursuant to Section 840.11 Wisconsin Statutes.

Schilling’s Plat of Point Comfort recorded in Volume 2 of Plats, Page 141, Brown County Records, being described in the Town of Scott Assessor’s Plat No.3 recorded in Volume 19 of Plats, Pages 209 thru 217, Brown County Records, and being a part of the Northeast 1/4 of the Northeast 1/4 of Section 29, Town 25 North, Range 22 East, Town of Scott, Brown County, Wisconsin more fully described as follows:

FOR ELECTORS TO ADOPT THE TOWN TAX LEVY
AT SPECIAL MEETING OF THE ELECTORS
WHEREAS, Wisconsin State Statutes Chapter 60.10(1)(a) authorizes the town electors of a town to adopt the town tax levy at a town meeting of the electors; and;
WHEREAS, a special town meeting of the electors has been called for this 6th day of November, 2019; and;
NOW, THEREFORE IT BE RESOLVED, that the special town meeting of the Town of Scott, Brown County, Wisconsin, by a majority vote of the eligible electors voting on this 6th day of November, 2019 duly assembled and voting resolves and orders as follows:
BE IT RESOLVED, the town electors of the Town of Scott, Brown County, Wisconsin hereby adopt the town tax levy for 2019 to be collected in 2020 in the amount of $866,874.
BE FUTHER IT RESOLVED, that the Town Clerk shall properly post this resolution in three places or publish this resolution once in a qualified newspaper as required by law under Wisconsin State Statutes Chapter 60.80 within 30 days of adoption.
BE FUTHER IT RESOLVED, that this Resolution is permanently entered in the record of the proceeding of the Town of Scott, Brown County, Wisconsin.

Billing: Bills for water service are rendered quarterly and become due and payable upon issuance following the period for which service is rendered. A late payment charge of 1 percent per month will be added to bills not paid within 20 days of issuance. This late payment charge shall be applied to the total unpaid balance for utility service, including unpaid late payment charges. This late payment charge is applicable to all customers. The utility customer may be given a written notice that the bill is overdue no sooner than 20 days after the bill is issued. Unless payment or satisfactory arrangement for payment is made within the next 10 days, service may be disconnected pursuant to Wis. Admin. Code ch. PSC 185.

Combined Metering: For a residential customer with more than one meter on a single service lateral, volumetric reading from all meters shall be combined for billing. For a nonresidential customer, volumetric readings may be combined for billing if the utility for its own convenience places more than one meter on a single water service lateral. Multiple meters placed for the purpose of identifying water not discharged into the sanitary sewer are not considered for utility convenience and may not be combined for billing. This requirement does not preclude the utility from combining readings where metering configurations support such an approach. Volumetric readings from individually metered separate service laterals may not be combined for billing purposes.
